These Terms of Service (the “Terms”) are an agreement between you and Talent Acceleration Platform (TAP) B.V. (“TAP”, “we”, “us”, “our”), a company registered with the Netherlands Chamber of Commerce (KVK) under number 87362449, with its registered office at Singel 542, 1017 AZ Amsterdam, the Netherlands.
They govern access to and use of the TAP Careers platform, including our websites (the “Sites”), applications, and features (together, the “Service”). By creating an account, or by accessing or using the Service, you agree to these Terms. If you are registering an account or using the Site or Platform on behalf of an individual or entity other than yourself, you represent that you are authorized by such individual or entity to accept these Terms on such individual's or entity's behalf. If you do not agree to these Terms, please do not use the Service.
TAP is used in different ways, and these Terms apply to both:
- As a Job Seeker or Visitor. Individuals use TAP to browse available Opportunities, apply for them, and access career support such as mentoring, coaching, and job-search tools. Section 4 contains terms that apply specifically to you.
- As an Employer. Companies and other organizations engage TAP to provide job search, talent sourcing, and related recruitment services. Section 5 contains terms that apply specifically to Employers and their Employer Users.
All other sections apply to everyone unless they say otherwise.
Job Seekers, Visitors, Mentors, and Coaches. How we handle your personal information is explained in our
Privacy Notice. By using our Services, you acknowledge that you have read and understood our
Privacy Notice, which describes how we collect and use your personal information.
Employers. An Employer’s use of the Service is also governed by its written agreement with TAP (the “Order Form”). Where TAP processes personal information on an Employer’s behalf, that processing is governed by the
Data Processing agreement between TAP and the Employer (the “DPA”), which is hereby incorporated by reference. If these documents conflict, they apply in this order: (a) the DPA, for matters relating to the processing of personal information on the Employer’s behalf; (b) the Order Form; and (c) these Terms.
In these Terms:
- User: anyone who accesses or uses the Service, including Visitors, Job Seekers, Mentors, Coaches, and Employer Users.
- Visitor: a person who browses the publicly available parts of the Service, such as Opportunity listings, without creating an account.
- Job Seeker (TAPer): an individual who creates an account to look for or apply to Opportunities, or to access career support, mentoring, coaching, and job-search tools.
- Employer: a company or other organization, including a recruiter or agency acting on behalf of an employer, that engages TAP to provide job search, talent sourcing, or related services under an Order Form.
- Employer User: an individual authorized by an Employer to use the Service on the Employer’s behalf, such as a hiring manager or recruiter.
- Order Form: the order form, master services agreement, or other written agreement between TAP and an Employer.
- DPA: the data processing agreement between TAP and an Employer that governs TAP’s processing of personal information on the Employer’s behalf, as required by Article 28 of the GDPR.
- Opportunity: a job, internship, program, or other opening listed on or made available through the Service.
- Mentor: a person who volunteers or is engaged to mentor Job Seekers through the Service.
- Coach: a person engaged to deliver coaching sessions through the Service.
- Coffee Chat: a scheduled conversation between a Job Seeker and a Mentor, held over a video call through the Service.
- Notetaker: our optional AI feature that, with consent, records and transcribes a Coffee Chat and generates notes.
- Content: anything a User submits to the Service, including profiles, CVs, messages, Opportunity listings, files, and feedback.
- GDPR: Regulation (EU) 2016/679, the General Data Protection Regulation.
3.
Eligibility and Accounts
You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate and up to date.
Some parts of the Service, such as browsing Opportunity listings, are available without an account. To apply for Opportunities, store your information, or use most other features, you must register for an account. You are responsible for keeping your login details secure and for activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission. You must provide accurate information and keep it current. Accounts are personal and must not be shared.
If you register as an Employer User, you confirm that you are authorized to use the Service on the Employer’s behalf and, where you accept these Terms for the Employer, that you have authority to bind it.
To protect Users and the integrity of the Service, we or our service providers may ask you to verify your identity or, for Employers, the organization’s legitimacy. If you do not provide the verification we reasonably request, we may limit or refuse access to some or all of the Service.
4.
Terms for Job Seekers and Visitors
4.1
Your License to Use the Service
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to use the Service for your own non-commercial purposes, such as finding and pursuing Opportunities and developing your career. You may not download, copy, scrape, distribute, or commercially exploit Content on the Service that you do not own, except as the Service’s features expressly allow (for example, saving an Opportunity or downloading your own CV).
4.2
Browsing and Applying for Opportunities
Opportunities may be published by Employers, by TAP on an Employer’s behalf, or sourced from third parties. Each Employer is responsible for the accuracy and lawfulness of its Opportunities. We take reasonable steps to keep listings genuine and current, but we do not verify every detail, and we do not guarantee that any Opportunity is still available, accurately described, or will lead to an interview or offer.
When you apply for an Opportunity, or agree to be put forward to an Employer, we share your profile and application information with that Employer, as described in the
Privacy Notice. The Employer then makes its own decisions about your application and handles your information under its own privacy notice. Any offer, contract, or employment relationship is between you and the Employer.
Employers on TAP must never ask you to pay to apply for an Opportunity or to receive an offer. If an Opportunity or contact seems suspicious, do not share financial information, and report it to us at privacy@tapcareers.io.
4.3
Fees and your consumer rights
Browsing Opportunities and applying for them is free for Job Seekers. Some programs or features may involve fees. Where they do, the applicable fees, what is included, and payment terms will be shown to you before you commit. Payments are processed by our payment providers
Sponsored participants may access programs funded by an organization (a “Sponsor”) on terms agreed with that Sponsor. Where a program is sponsored, we will tell you what information, if any, is shared with the Sponsor, as described in the
Privacy Notice.
This section applies to Employers and Employer Users. It supplements the Order Form and the DPA, which prevail as set out in Section 1.
5.1
Nature of TAP’s Services to Employers
TAP provides Employers with job search and talent sourcing services, which may include publishing Opportunities, identifying and presenting Job Seekers, and tools to manage and communicate with candidates. TAP presents Job Seekers for the Employer’s independent consideration, based on the information the Employer provides to TAP, and the information Job Seekers choose to share.
The Employer acknowledges and agrees that:
- it is solely responsible for its recruitment and hiring decisions, and for evaluating the qualifications, integrity, and suitability of any Job Seeker with whom it communicates through the Service, including any background or reference checks;
- TAP does not guarantee that the Employer will find or hire suitable candidates, or that any Job Seeker will accept an offer or remain in a role, unless expressly agreed in the Order Form;
- TAP makes no representations or warranties about any Job Seeker or the quality of the work they may perform, beyond any obligations TAP expressly accepts in the Order Form; and
- TAP does not charge Job Seekers any fee for featuring them on, or presenting them through, the Service.
Subject to these Terms and the Order Form, we grant the Employer a non-exclusive, non-transferable, revocable license, for the term of the Order Form, to allow its Employer Users to use the Service for the Employer’s internal recruitment purposes. The Employer is responsible for its Employer Users’ compliance with these Terms and for all activity under their accounts.
5.3
Employer responsibilities
Each Employer agrees that it will:
- publish only genuine, accurate, and current Opportunities that it is authorized to recruit for, and update or remove them promptly when they are filled or change;
- comply with all applicable laws, including employment, equal treatment and anti-discrimination, immigration and right-to-work, and data protection laws, and not use selection criteria that unlawfully discriminate;
- not charge Job Seekers any fee in connection with applying for, or being offered, an Opportunity;
- use Job Seeker information obtained through the Service only to recruit for the relevant Opportunities, and not sell, disclose, or use it for unrelated purposes such as marketing;
- not contact Job Seekers through the Service for purposes unrelated to genuine recruitment; and
- ensure that hiring decisions are made by a person who reviews the relevant information, and not solely on the basis of TAP’s matching, ranking, or AI-generated outputs.
Fees, invoicing, and payment terms for Employers are set out in the applicable Order Form. Unless the Order Form says otherwise, fees are exclusive of VAT and other applicable taxes.
6.
AI Features and the Notetaker
Some features use artificial intelligence. In particular, the Notetaker can record and transcribe your Coffee Chats and generate summaries and suggested next steps, and we may use transcripts to enrich your profile. These AI features are optional and run only where the required consent has been given.
- Recording and transcription happen only when both participants of a Coffee Chat have consented. If either person has not consented, the chat is not recorded.
- You give a single consent to turn the Notetaker on, and you can give, change, or withdraw it at any time in your privacy settings. Withdrawing consent affects future Coffee Chats, not ones already recorded.
- AI-generated notes are drafts for review, not a verified record, and TAP does not use them to make decisions that significantly affect you without a person reviewing first.
- You can use the Service, including Coffee Chats, without turning these AI features on. They are never a condition of receiving mentoring or support.
TAP also uses automated tools to help match Job Seekers with Mentors and Opportunities, and to help Employers identify relevant candidates. These tools produce recommendations to support human judgment. They do not make hiring decisions, and TAP does not use them to make decisions that produce legal or similarly significant effects on Job Seekers without meaningful human involvement. How recordings, transcripts, and notes are processed, stored, and deleted, and which providers are involved, is described in the
Privacy Notice.
To keep TAP a safe and respectful place, you agree not to:
- Misuse the Service, interfere with its operation, or try to access it in unauthorized ways.
- Upload or share Content that is unlawful, harmful, deceptive, discriminatory, or infringes anyone’s rights.
- Post false, misleading, or fraudulent Opportunities, profiles, or credentials.
- Share or record another person’s information without a lawful basis or record a Coffee Chat where consent has not been given.
- Harass, abuse, or misrepresent yourself to other Users.
- Use the Service, or information obtained through it, to discriminate unlawfully against anyone.
- Use the Service to send spam, or to scrape or harvest data beyond what the features intend.
We may investigate and take action, including removing Content or suspending accounts, where these Terms are breached.
You keep ownership of the Content you submit. You grant TAP a non-exclusive, worldwide license to host, store, process, and display your Content for the purpose of operating and improving the Service, in accordance with the
Privacy Notice or, where applicable, the DPA. For Employers, this includes publishing and promoting Opportunity listings on the Service. This license ends when your Content is deleted from the Service, except where we need to keep it for legal reasons or it has already been shared with other Users as you directed.
You are responsible for having the rights to the Content you provide, and for making sure it is accurate and appropriate.
Mentors and Coaches offer guidance based on their own experience. They are not employees or agents of TAP unless separately agreed, and TAP does not guarantee any particular advice, outcome, or availability. Mentors, Coaches, and Job Seekers agree to treat each other, and any information shared during sessions, with respect and confidentiality.
The Service works with third-party providers to deliver features (for example, calendar connections and the AI providers behind the Notetaker). Your use of those features may also be subject to the third party’s own terms. We list the providers that process personal information in our
Privacy Notice and, for Employers, in the sub-processor list referred to in the DPA.
The Service, including its software, design, brand, and content created by TAP, belongs to TAP or its licensors and is protected by law. These Terms do not give you any rights in TAP’s intellectual property beyond using the Service as allowed here.
12.
Privacy and Data Protection
12.1
Job Seekers, Visitors, Mentors, and Coaches
TAP is the data controller for the personal information of Job Seekers, Visitors, Mentors, and Coaches processed through the Service. We process this data in line with the GDPR and our
Privacy Notice, which explains what we collect, why, the legal bases, the providers involved, international transfers, retention, and your rights.
When we share a Job Seeker’s information with an Employer (for example, when you apply for an Opportunity), the Employer uses it as a separate controller for its own recruitment purposes, and the Employer’s own privacy notice applies.
Where TAP processes personal information on an Employer’s behalf as part of the services under the Order Form (for example, candidate data the Employer uploads or asks TAP to manage), TAP acts as the Employer’s processor, and that processing is governed by the DPA. The Employer is responsible for having a lawful basis for that data and for giving the individuals concerned any required information.
Where an Employer receives Job Seeker information through the Service, the Employer acts as an independent controller of that information and is responsible for its own compliance with data protection law and will do so in compliance with the Employer C2C
Data Processing Addendum.
TAP is the controller of the personal information of Employer Users, such as names, business contact details, and account activity, which we process as described in the
Privacy Notice.
For any privacy question or to exercise your rights, contact privacy@tapcareers.io.
TAP helps you pursue opportunities but does not promise employment, a specific number of introductions, candidates, or hires, or any particular result. To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis, subject to any commitments in an Order Form. AI-generated content can contain errors and should be reviewed before you rely on it. Nothing in this section affects your statutory rights as a consumer.
14.
Limitation of Liability and Indemnity
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or for damage caused by intent or deliberate recklessness.
Job Seekers and Visitors. Subject to the paragraph above, TAP is not liable for loss that was not reasonably foreseeable, or for loss caused by the conduct of Employers, other Users, or third parties. Nothing in these Terms affects your statutory rights as a consumer.
Employers. Subject to the first paragraph of this section, TAP’s liability to an Employer is limited as set out in the Order Form. Where the Order Form contains no limitation, TAP is not liable for indirect or consequential loss, or for loss of profits, revenue, or goodwill, and TAP’s total liability in any 12-month period is limited to the fees paid by the Employer in the twelve (12) months before the event giving rise to the claim.
Indemnity by Employers. Each Employer will defend, indemnify and hold harmless TAP and its affiliates, officers, employees and agents from and against all third-party claims, and the resulting losses, damages, fines (where the law allows them to be indemnified) and reasonable legal costs, to the extent they arise from: (a) a breach of these Terms, the Order Form or the DPA by the Employer or any of its Employer Users; (b) Opportunities and other Content submitted by the Employer or its Employer Users; (c) the Employer’s recruitment, hiring, employment or dismissal of any Job Seeker, including claims relating to discrimination, pay, immigration or right to work; or (d) the Employer’s processing of Job Seeker information in breach of data protection law or the DPA. The Employer is responsible for the acts and omissions of its Employer Users as if they were its own. An Employer User who uses the Service outside the authority given by the Employer, or for their own purposes, gives the same indemnity personally.
Indemnity by Job Seekers. To the extent permitted by applicable law, each Job Seeker will indemnify TAP and its affiliates, officers, employees and agents against third-party claims, and the resulting losses and reasonable legal costs, to the extent they arise from the Job Seeker’s: (a) breach of these Terms, including the acceptable use rules in Section 7; (b) Content that is false, misleading or unlawful, or that infringes anyone’s rights, such as falsified credentials or a CV the Job Seeker has no right to share; or (c) fraud or wilful misconduct. This indemnity does not apply to the extent the loss was caused by TAP, and nothing in it affects your statutory rights as a consumer.
Indemnity procedure. TAP will promptly notify the indemnifying party of any claim covered by this section, allow it reasonable control of the defence and settlement, and give reasonable cooperation at its cost. The indemnifying party may not settle a claim in a way that admits fault by TAP or imposes obligations on TAP without TAP’s written consent.
15.
Suspension and Termination
Job Seekers, Mentors, and Coaches can stop using the Service and delete their account at any time. Employers may terminate as set out in the Order Form.
We may suspend or end your access if you seriously or repeatedly breach these Terms, or where necessary for legal, security, or operational reasons. Where reasonable, we will tell you why and give you an opportunity to respond, unless doing so would compromise security, an investigation, or our legal obligations. For Employers, the suspension and termination provisions of the Order Form also apply.
When an account is closed, we handle any remaining personal information as described in the Privacy Notice or, for data processed on an Employer’s behalf, the DPA. Sections 8, 11, 13, 14, and 17 continue to apply after your use of the Service ends.
16.
Changes to These Terms
We may update these Terms from time to time, in our sole discretion. Any changes will become effective when we post the revised Terms on the Site. Your continued use of the Site after the revised Terms are posted constitutes your acceptance of the updated Terms. If you do not agree to a change to the Terms, you should stop using the Service and close your account before it takes effect.
For Employers, changes to these Terms do not amend the Order Form or the DPA, which can only be changed as those documents provide.
17.
Governing Law and Disputes
These Terms are governed by the laws of the Netherlands. Any dispute will be subject to the exclusive jurisdiction of the competent courts of Amsterdam, unless the Order Form or mandatory law provides otherwise.
If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in the courts of that country. We encourage you to contact us first so we can try to resolve any issue informally.
